The recent amendment to Law 18.216 completes a silent process of insertion of actuarial technologies of risk prediction of recidivism among offenders. These technologies are closely linked to changes that Anglo-Saxon penal systems have experienced in the past 30 years. This paper aims to explain the origins of these technologies, their content and what are the main problems and challenges that their introduction poses to the penal system. This paper will contrast two types of explanatory speeches of risk paradigm that, while epistemologically different, allow us to have a more complete picture of the analyzed scenario.

In effect, the recent reform of Law 18.216 -carried out by Law 20.603-, which has eliminated the old “alternative measures” and replaced them with a new system of “alternative sentences”, has generated a new paradigm within our penitentiary system. This change has had a particular impact on the evaluation of those subjects (lawbreakers) to see if they are fit to serve their sentence in the free environment. Specifically, Article 33 of the new law explicitly states the evaluation of “recidivism risk factors”. This reform is the culmination of a silent process that has allowed the Ministry of Justice to introduce actuarial instruments to evaluate the risk of recidivism of law offenders in the Chilean penal system.1
